The process of Immigration Pardon or Legal Waiver allows different types of American Visa applicants who have a criminal record in the United States to fix their immigration status and obtain a Visa to return to the United States.

There are two types of forms for requesting the Immigration Waiver: I-212 Form to request permission to return to the United States after Deportation, and the second is the I-601 Form to request the Legal Waiver for certain inadmissibility.

Each particular case is very different. I-212 FORM permission request to return to the United States after Deportation.

The I-212 form may be processed by two different agencies: Either USCIS Department (US CITIZENSHIP AND IMMIGRATION SERVICES) or the CBP Department (CUSTOMS AND BORDER PROTECTION), since the process is different for Immigrant Visa or Non-Immigrant Visa.

When is it addressed to the USCIS Department?

The I-212 form must be addressed to the USCIS Department when applying for an Immigrant Visa or a Non-Immigrant Visa but later applying for immigrant status.

When is it addressed to the CBP Department?

The I-212 form must be addressed to the CBP Department when requesting a Nonimmigrant Visa and not applying for Immigrant Status later. For example:

The K-type Fiancé Visa is a NON-Immigrant Visa, but once the Visa is approved and obtained, the process to adjust immigration status continues in the United States.

When there is a prior criminal record and inadmissibility, the I-212 form should be addressed to CBP. In addition, it will be necessary to attend an interview at the American Consulate.

I-601 Form, request for Legal Waiver to correct certain inadmissibility's.

For the I-601 Form to USCIS, the applicant must leave the United States to continue this immigration process. But it depends on each particular case as there are exceptions.

When presenting an I-601 form, the reason for the inadmissibility must be marked, as there are different types of inadmissibilities.
